Environmental Health Professionals Australia Payment Policy and Terms & Conditions

The following terms and conditions apply to all members of Environmental Health Professionals Australia Limited (EHPA), ABN 33 917 298 751 unless specified. It sets out member rights, EHPA’s commitment to members, and member responsibilities to the EHPA, together with where members should seek assistance if required.

These Terms and Conditions apply for the 2020-2021 membership year and beyond unless otherwise superseded.

PAYMENTS

  1. Payment methods: EHPA offers the following options for payment of the annual membership subscription fees:
    1. Payment may be made by VISA, MasterCard, Paypal, electronic funds transfer or cheque. Other forms of credit or debit cards will not be accepted.
    2. All online payments by credit card will attract a 1.5% fee to be paid when completing the transaction.
    3. Payment at the time of application to join or re-join EHPA as a former member,  EHPA requires the applicant to tender the full annual membership fees.
    4. Rejected applications: Except for Student Subscriber Member applications which are free, if an application is rejected, a refund will be arranged for the amount paid. In the case of rejected applications to join as a Student Subscriber, no refund will be paid. The processing fee is the amount paid.
    5. Reinstatement amount payable If a lapsed or ex-member seek to reinstate their membership in the same EHPA membership year during which their membership expired, they must pay the total relevant annual membership fee or their outstanding balance for the full EHPA membership year.
      Former members wanting to reinstate their membership after the EHPA membership year in which their EHPA membership ceased, must pay the total fee relevant at the time of applying for reinstatement.

RETURNS AND REFUNDS

  1. EHPA handles returns and processes refunds in accordance with the Australian Consumer Protection legislation.
    1. Should you wish to return your order, please notify us within 14 days of purchase with a valid reason for return. If we are unable to resolve your complaint or further assist you, we will process a refund upon timely receipt of the goods purchased. Unopened goods will be refunded in full. Refunds will be processed promptly and payment made by the same method that you made payment. All refunds are made at the discretion of EHPA.

MEMBERSHIP

  1. Constitution
    All Members of EHPA are bound by the Constitution and Code of Ethics and any other rules or regulations adopted by the EHPA. (Copies of the above documents are available on the EHPA website, ehpa.org.au or from the EHPA Executive Officer. In the event of any inconsistency, the Constitution will prevail.
  2. EHPA Membership Subscriptions
    1. EHPA membership year: EHPA membership year runs from 1st July to 30th June.
    2. Payments are to be made in full unless partial payments have been approved by the EHPA Executive Officer or Board of Directors.
    3. Full payment for members joining on 1st July or current members renewing membership
    4. The full amount billed (includes any early-bird discounts that may be offered),  must be paid by 31st July.
    5. If payment is outstanding for 45 days or longer, members will be deemed inactive and may be removed from the EHPA membership register.
    6. For members joining, after the 31st July, a pro-rate payment scheme applies. Please see the membership page on our website  for details: ehpa.org.au.
    7. Payment at the time of application to join or re-join EHPA as a former member, EHPA requires the applicant to tender the full annual membership fees.

  3. Resigning your EHPA membership
    In accordance with the Constitution, a member may resign membership of the EHPA, by sending a notice to the registered office of EHPA. Where the notice of resignation does not include a resignation date, membership will cease at the conclusion of the membership year. The notice may be sent by email to info@ehpa.org.au or write to Membership Officer, Environmental Health Professionals Australia PO Box 378, Diamond Creek, Victoria 3089. If a member chooses to resign prior to 30th June, the member is not entitled to a refund of the annual membership subscription.

EVENTS

  1. By completing and sending this form, it is understood that you have read and agreed to the cancellation policy:
    1. Cancellation on or before 14 days prior to the event - Administration Fee $75. Cancellation within 14 days of the event- Full Registration Fee will be charged. All cancellations must be directed to the Symposium Secretariat in writing.
    2. By registering for this event, relevant details will be held in a database held by EHPA. A list of delegates (name, organisation & email) will be available to sponsors and exhibitors. Please email the Symposium Secretariat if you do not wish your details included in delegate lists.

PRODUCT SALES

COMPETITION AND CONSUMER ACT

  1. For the purposes of Schedule 2 of the Australian Consumer Law, in particular, Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), EHPA’s liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.
    You must be over 18 years of age to use this website and to purchase any goods or services.

DELIVERY OF GOODS

  1. Physical goods may be delivered by Australia Post and/or other reputable courier companies. Deliveries are processed promptly upon receipt of full payment. Delivery may take between 2 and 14 days, depending on the delivery option. Damaged or lost orders should be resolved with Australia Post or the courier company directly, and we are not responsible for goods that are damaged in transit or not received. Replacement of damaged or lost items is made at the discretion of EHPA.

YOUR PRIVACY

  1. At EHPA, we are committed to protecting your privacy. We use the information we collect about you to maximise the services that we provide to you. EHPA respects the privacy and confidentiality of the information provided by you and adheres to the Australian Privacy Principles. Please read our separate Privacy Policy carefully.
    You may change your details at any time by advising us in writing via email. All information we receive from our customers is protected by our secure servers. EHPA’s secure server software encrypts all customer information before it is sent to us. Furthermore, all of the customer data EHPA collects is secured against unauthorised use or access. Credit card information is not stored by us on our servers.

THIRD PARTIES

  1. EHPA does not and will not sell or deal in personal or customer information. We may, however, use in a general sense without any reference to your name, your information to create marketing statistics, identify user demands and to assist it in meeting customer needs generally. In addition, we may use the information that you provide to improve its websites and its services but not for any other use.

DISCLOSE YOUR INFORMATION

EHPA may be required, in certain circumstances, to disclose information in good faith and where EHPA is required to do so in the following circumstances: by law or by any court; to enforce the terms of any of our customer agreements; or to protect the rights, property or safety of our customers or third parties.

EXCLUSION OF COMPETITORS

  1. If you are in the business of creating similar documents, goods or services for the purpose of providing them for a fee to users, whether they be business users or domestic users, then you are a competitor of EHPA. EHPA expressly excludes and does not permit you to use or access our website, to download any documents or information from its website or obtain any such documents or information through a third party. If you breach this term, then EHPA will hold you fully responsible for any loss that we may sustain and further hold you accountable for all profits that you might make from such unpermitted and improper use. EHPA reserves the right to exclude and deny any person access to our website, services or information in our sole discretion.

COPYRIGHT, TRADEMARK AND RESTRICTIONS OF USE

  1. This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance, trademarks and graphics. You are not permitted to reproduce the documents, information or materials on the websites for the purposes of sale or the use by any third party. In particular, you are not permitted to republish, upload, transmit electronically or otherwise or distribute any of the materials, documents or products that may be available for download from time to time on these websites.
  2. EHPA expressly reserves all copyright and trademark in all documents, information and materials on our websites and we reserve the right to take action against you if you breach any of these terms.
    Any redistribution or reproduction of part or all of the contents in any form is prohibited other than the following: you may print or download to a local hard disk extracts for your personal and non-commercial use only, and you may copy the content to individual third parties for their personal use, but only if you acknowledge the website as the source of the material.
  3. You may not, except with our express written permission, distribute or commercially exploit the content. Nor may you transmit it or store it on any other website or other form of electronic retrieval system.

PHOTOGRAPHY AND RECORDING

  1. I irrevocably authorise and grant EHPA the right to:
    1. record me (picture and voice) on photographs or video footage, film and/or videotape, for audio and visual production. (the Recording)
    2. edit the Recording into a photo gallery/short film/webinar (which may include other recordings and material);
    3. use my name and likeness, voice or other information concerning me; and
    4. screen or place online (including on social media) the Recording.
  2. I hereby release EHPA from any infringement or violation of personal and/or property rights of any sort whatsoever based upon the use of the Recording. I acknowledge that EHPA owns and shall own all rights, title and interest (including copyright) in the Recording. I further acknowledge that EHPA is not obliged to use the Recording. I warrant that I have full power to enter into this Release and that the terms of this Release do not in any way conflict with any existing commitment on my part. I understand I will receive no monies for this Recording.
  3. While under no obligation to do so, the EHPA will consider any reasonable request not to use or to stop using a particular Recording. Such requests should be made in writing to info@ehpa.org.au. Should you not wish to grant EHPA these rights, please contact the EHPA, on 039438 5960 or info@ehpa.org.au at least two weeks prior to the event.

WHOLE AGREEMENT

  1. These terms and conditions represent the whole agreement between you and EHPA concerning your use and access to EHPA’s website and your use and access to the documents and information on it. No other term is to be included in this agreement except where it is required to be included by any legislation of the Commonwealth or any State or Territory. All implied terms except those implied by statute and which cannot be expressly excluded are hereby expressly excluded.

EXCLUSION OF UNENFORCEABLE TERMS

  1. Where any clause or term above would by any applicable statute be illegal, void, or unenforceable in any State or Territory then such a clause shall not apply in that State or Territory and shall be deemed never to have been included in these terms and conditions in that State or Territory. Such a clause if legal and enforceable in any other State or Territory shall continue to be fully enforceable and part of this agreement in those other States and Territories. The deemed exclusion of any term pursuant to this paragraph shall not affect or modify the full enforceability and construction of the other clauses of these terms and conditions.

JURISDICTION

  1. This agreement and this website are subject to the laws of Victoria and Australia. If there is a dispute between you and EHPA that results in litigation, then you must submit to the jurisdiction of the courts of Victoria.
